Terms of Use
1. Who we are
W‑Cut is a mobile app provided by Okan Yuksel, a sole trader (autónomo) registered in Spain.
- Registered address: Gran Via de les Corts Catalanes 672, 08010 Barcelona, Spain
- Tax ID (NIF/NIE): Z4123153V
- Email: support@wcut.app
In these Terms, “we”, “us” and “our” mean Okan Yuksel. “You” and “your” mean you, the person using the app. “W‑Cut” and “the app” mean the W‑Cut mobile application and the services it connects to.
2. These Terms
These Terms of Use are a binding agreement between you and us. They apply every time you download, open or use W‑Cut.
By using W‑Cut you accept these Terms and our Privacy Policy, which explains what we do with your photos and your data. If you do not accept them, do not use the app.
If you use W‑Cut through Apple’s App Store, Apple’s own terms also apply to your download and your payments. See section 20.
3. Who can use W-Cut
You must be at least 16 years old to use W‑Cut. The app asks your age before you start and will not let you continue if you are younger.
W‑Cut analyses photographs of faces. We do not knowingly allow anyone under 16 to use it. If you believe a child under 16 is using the app, email support@wcut.app and we will close the account.
You must also be legally able to enter into a contract where you live, and you must not be barred from using the app under the laws that apply to you.
4. Your account
There is no sign-in. W‑Cut does not ask for an email address, a password, or a Google or Apple login. When you first open the app it creates an anonymous account on your device automatically. That account is identified only by an account number, which you can see and copy in Settings → Your data.
This keeps the app private — we never learn who you are. It also has a consequence you need to understand:
One exception: a paid subscription is tied to your Apple ID, not to your W‑Cut account. You can restore a subscription on a new device with Restore Purchases. Your scan history, your generated images and your credit balance cannot be restored this way.
If you contact support, quote your account number from Settings → Your data. Without it we usually cannot find your records.
You are responsible for use of the app on your device.
You may delete your account at any time from Settings → Delete Account. This is immediate and permanent. It removes your data as described in the Privacy Policy and ends any credits or benefits attached to it. There is no undo.
5. What W-Cut does — and what it does not do
W‑Cut takes photographs of your face, sends them to AI models for analysis, and gives you:
- an assessment of features such as face shape, hairline, crown and hair texture;
- a ranked list of haircuts and beard styles that suit those features;
- AI-generated images that simulate how a haircut might look on you.
Please read this part carefully:
- The results are opinions produced by software, not facts. The AI can be wrong. It can read your face shape or hairline incorrectly, and it can recommend a style that does not suit you.
- Generated images are simulations, not photographs. They show an approximation. They are not a preview of a real haircut and not a promise of any outcome. What a barber or stylist actually produces will differ, sometimes a lot.
- W‑Cut is not professional advice. It is not medical, dermatological, psychological or professional styling advice. It does not diagnose hair loss, scalp conditions or any other health matter. If you are worried about your hair or scalp, see a doctor.
- Do not make decisions you cannot undo based only on W‑Cut. Talk to a qualified barber or stylist before a major change.
W‑Cut is provided for personal, non-commercial entertainment and guidance.
6. The photos you upload
You keep ownership of your photos. We do not claim them.
To make the app work, you give us a limited licence to store your photos, send them to the AI providers listed in our Privacy Policy, process them, and show the results back to you. That licence exists only to run the service for you. It ends when the photos are deleted.
We delete the photographs you upload 30 days after you take them, automatically. Your written results are kept longer, as explained in the Privacy Policy. This means a result older than 30 days will show no portrait photo. That is intended, not a fault.
You can delete your photos and scan results earlier from Settings → Delete face scans & photos.
Your promises about photos. By uploading a photo you confirm that:
- it is a photo of you, or of a person who has given you clear permission;
- you have the right to upload it;
- it does not contain a child;
- it is not illegal, and it does not infringe anyone’s rights.
Uploading someone else’s face without their permission is a serious breach of these Terms and may also break the law where you live.
7. The images W-Cut generates for you
Images that W‑Cut generates from your photos are yours to keep, save and share, for personal use, as far as we are able to grant that.
Two limits apply:
- You may not present them as real photographs. They are AI-generated. If you post one publicly in a way that could mislead people, say so.
- You may not use them to deceive, impersonate, harass or harm anyone, or to create content that is illegal, sexual, hateful or defamatory.
We may keep a copy of generated images so they appear in your history. You can delete them one at a time from your history, or all at once by deleting your account.
8. Free use, paid plans and billing
Free. New users get a limited free allowance: one face scan and one generated image. After that, generating more requires a paid plan.
Paid plans. W‑Cut offers paid subscription plans, currently billed weekly or annually. What each plan includes, and the exact price in your currency, is shown on the purchase screen inside the app before you pay. Prices vary by country and can change.
Apple handles the money. All purchases are Apple in-app purchases. Apple takes the payment, issues the receipt and holds the billing relationship. We never see your card details.
Auto-renewal. Subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the current period ends. Your Apple ID is charged on renewal.
How to cancel. Cancel in Settings → your name → Subscriptions on your iPhone, or at any time from your Apple ID account page. Cancelling stops the next renewal. It does not refund the period you already paid for, and you keep access until that period ends. We cannot cancel a subscription for you — only Apple can.
Refunds. Refunds for App Store purchases are handled by Apple, under Apple’s policies. Request one at reportaproblem.apple.com. We do not process refunds ourselves and generally cannot overrule Apple’s decision.
Statutory rights. If you live in the EU, the EEA or the UK, you may have a legal right to withdraw from a purchase within 14 days. That right can be lost once digital content is delivered immediately with your agreement. These Terms do not take away any right the law gives you. Where Apple is the seller, exercise the right through Apple.
Free trials and offers. If we offer a free trial or an introductory price, the length and the price after it are shown before you confirm. Unless you cancel before the trial ends, it converts to a paid subscription automatically.
9. Credits
Generating images uses credits.
- A paid weekly plan includes 20 credits per week.
- Weekly credits do not stack. At the start of each new week your weekly balance is topped up to the plan’s amount — it is not added to what was left. If you used none last week, you start this week with the same weekly amount, not double.
- Credits you buy separately are different. Credit packs purchased as a one-off top-up stay in your balance until you spend them. They are not reset by the weekly top-up.
- Credits have no cash value. They cannot be exchanged for money, transferred to another person or another account, or refunded once spent.
- All credits, bought or included, end when your account is deleted.
- If a generation fails because of a fault on our side, we will return the credit. If it succeeds but you dislike the result, the credit is spent — the work was done.
We may change how many credits a plan includes. If we reduce it, we will tell you before it takes effect, and you may cancel.
10. Rules of use
You agree not to:
- upload a photo of anyone who has not agreed to it, or any photo of a child;
- upload content that is illegal, hateful, sexual, violent, harassing or infringing;
- use W‑Cut to impersonate a real person or to create misleading material about them;
- reverse engineer, decompile, copy or resell the app or any part of it;
- scrape the app, automate requests, or use bots or scripts against it;
- work around credit limits, free-tier limits, payment checks or security controls;
- overload, attack, or interfere with our servers or anyone else’s use of the app;
- resell access, share your account, or use W‑Cut to run a commercial service, unless we agree in writing.
11. Reporting a problem
If you see content or a result that you believe breaks these Terms — including a generated image of you that you did not authorise — email support@wcut.app with enough detail for us to find it. We aim to reply within a reasonable time and will remove content that breaks these Terms.
We may review, restrict or remove content, and we may refuse a request, where we reasonably believe these Terms or the law have been broken. We are not obliged to monitor content proactively.
12. Suspending or ending your access
You can stop using W‑Cut at any time, and delete your account from Settings.
We may suspend or end your access, with notice where practical, if:
- you break these Terms;
- we are required to by law;
- your use puts other users, our providers or our systems at risk;
- we stop offering W‑Cut, or stop offering it in your country.
If we end your access because you broke these Terms, unused credits are forfeited and no refund is due, except where the law requires one. If we end it for any other reason and you have paid for a period you cannot use, we will arrange a fair pro-rata refund through Apple where possible.
13. Our intellectual property
We own the copyright in W‑Cut: its software, design, text, illustrations, animations, style catalogue and the instructions we send to the AI models. Copyright arises automatically on creation and is protected in Spain and internationally under the Berne Convention. Some components are licensed to us by others, and remain theirs.
We do not claim a registered trade mark in the name “W‑Cut” or in our logo. Both are still protected by copyright as creative works, and by the law on unfair competition and passing off where it applies.
We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use W‑Cut on devices you own or control, for your own personal use. Nothing else is granted. You may not copy, republish or redistribute the app or its content.
14. Feedback
If you send us an idea, a suggestion or a bug report, we may use it freely, without payment or obligation to you. Please do not send us anything you consider confidential.
15. Changes to the app
W‑Cut is an evolving product. We may add, change, or remove features, styles and models, and we may change the AI providers we use. We may pause the service for maintenance. We will avoid removing a feature you have paid for; where we cannot, you may cancel your subscription.
16. Changes to these Terms
We may update these Terms. When we make a material change we will tell you in the app before it takes effect, and update the date at the top. We have no email address for you, so the app is the only way we can reach you — please read the notice when it appears.
If you keep using W‑Cut after a change takes effect, you accept the new Terms. If you do not accept them, stop using the app and delete your account.
17. No warranty
W‑Cut is provided “as is” and “as available”.
To the fullest extent the law allows, we make no warranties of any kind about the app. In particular we do not warrant that:
- the AI’s analysis of your face is accurate;
- any recommendation will suit you;
- a generated image resembles what a barber will produce;
- the app will be uninterrupted, secure, or free of errors.
Nothing in this section removes rights you have as a consumer under the law of your country. In the EU and the UK, you have statutory rights about digital content being of satisfactory quality and as described, and those rights stand.
18. Limitation of liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special or consequential loss, for lost profits, lost data, or for damage to your reputation.
- We are not liable for the result of a haircut, or for any decision you make based on W‑Cut’s analysis, recommendations or generated images.
- Our total liability to you, for all claims taken together, is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50.
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. Some countries do not allow these limits, so parts of this section may not apply to you.
19. Your responsibility to us
If you break these Terms — in particular by uploading a photo of someone who did not agree, or by misusing a generated image — and someone brings a claim against us because of it, you agree to cover our reasonable costs and losses arising from that claim, to the extent the law permits and to the extent the claim results from what you did.
20. Apple
These Terms are between you and us only, not Apple. Apple is not responsible for W‑Cut or its content.
- Apple has no obligation to provide support for W‑Cut. Support requests go to support@wcut.app.
- If W‑Cut fails to conform to any warranty, you may tell Apple, and Apple will refund the purchase price. To the fullest extent the law allows, Apple has no other warranty obligation at all.
- Apple is not responsible for any claim about the app, including product liability claims, claims that it fails to meet a legal requirement, and claims under consumer protection or privacy law.
- Apple is not responsible for handling any third-party claim that the app infringes intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or listed as a “terrorist supporting” country, and you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
21. Governing law and courts
These Terms are governed by the laws of Spain.
Any dispute will be heard by the courts of Barcelona, Spain.
If you are a consumer, that is not the whole story — and it works in your favour. Nothing here removes the protection of the mandatory consumer laws of the country where you live, and in most countries you may bring a claim in your own local courts instead.
Small claims. Either of us may bring a claim in a small claims court, or the equivalent low-value court where you live, as long as the claim stays individual. Small claims courts are cheap and do not usually need a lawyer, and for most disagreements they are the sensible place to start.
Please talk to us first. Before starting any legal proceedings, please email support@wcut.app describing the problem, quoting your account number, and saying what you would like us to do. Most things are cheaper and faster to fix that way. This is a request, not a condition — it does not stop you going to court.
Consumers in the EU can also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
There is no arbitration clause in these Terms, and no class action waiver. We have not asked you to give up your right to go to court or to a jury.
22. Other terms
- Severability. If any part of these Terms is found invalid, the rest stays in force.
- No waiver. If we do not enforce a right straight away, we do not lose it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, and will tell you if we do.
- Whole agreement. These Terms and the Privacy Policy are the entire agreement between us about W‑Cut, and replace any earlier version.
- Language. These Terms are written in English. If we publish a translation and the two disagree, the English version governs, unless the law where you live says otherwise.
